Construction Claims

·        In a residential construction lawsuit filed post-TRCC, the primary cause of action will be pled as a breach of the major structural component statutory warranty and may also sound in negligence.   There will be an instruction under the relevant Texas statute, found in Texas Property Code Chapter 27, that a builder warrants that for ten (10) years the major structural components of a home, including the foundation and roof framing systems, among others, will meet certain performance standards specified in the Limited Statutory Warranty and Building and Performance Standards as prescribed by the Texas Residential Construction Commission.  Attorneys fees which are deemed to be both reasonable and necessary as well as engineering and consulting fees among a host of other damages are recoverable.    

·         In a commercial construction or municipal building related lawsuits, the prime causes of action pled will sound in breach of contract as well as negligence.
